تاثیر سبک زندگی اسلامی در پیشگیری از جرایم یقه سفیدها: بررسی فقهی و حقوقی

چکیده

  ویژگی‌های شخصیتی منفی، رابطه عمیقی با ارتکاب جرم و جنایت دارد. شخصیت هر شخصی، براساس ویژگی‌های شخصیتی او شکل می‌گیرد و اگر ویژگی شخصیتی منفی رشد کند، شخص را به سمت کارهای ناپسند سوق می‌دهد. هدف پژوهش حاضر بررسی فقهی و حقوقی تاثیر سبک زندگی اسلامی در پیشگیری از جرایم یقه سفیدها است. به طور سنتی، جرایم یقه سفید در جرم شناسی به عنوان جرایمی شناخته می شوند که افراد بلندپایه در محل کار مرتکب آن می شوند. در این پژوهش، با توجه به ماهیت و کیفیت پژوهش، شیوه پژوهش از نوع تحلیل اسنادی است و با توجه به موضوع پژوهش که به بررسی راهبردهای پیشگیری فقهی و حقوقی از این جرایم می پردازد، این پژوهش ازجمله پژوهش های بنیادی قرار می گیرد و ابزار پژوهش نیز شامل فرم های فیش برداری است و داده ها نیز با استفاده از شیوه های تحلیل کیفی، جمع آوری، طبقه بندی و تحلیل شده است. برخی از یافته‌های این پژوهش نشان می‌دهد که جایگاه و موقعیت بالای مجرمان یقه سفید در ساختارهای اجتماعی و اقتصادی مانع از خوردن هرگونه برچسب مجرمانه به این مجرمان می شود و سبک زندگی اسلامی نقشی مهمی در پیشگیری از این جرایم دارد.

چکیده [English]

Negative personality traits have a deep relationship with committing crimes. Each person's personality is formed based on her/her personality traits, and if a negative personality trait grows, it leads a person to do bad things. The purpose of the current research is to examine the jurisprudential and legal effects of Islamic lifestyle in preventing white-collar crimes. Traditionally, white collar crimes in criminology are known as crimes committed by high-ranking people at work. In this research, considering the nature and quality of this research, the research method is document analysis type, and considering the subject of this research, which examines jurisprudential and legal prevention strategies of these crimes, this research is one of the basic researches. The research tool also includes questionnaires and the data has been collected, classified and analyzed using qualitative analysis methods. Some of the findings of this research show  that the high status of white collar criminals in social and economic structures prevents these criminals from being labeled as criminals and Islamic lifestyle plays an important role in preventing these crimes.
