Abstract
Imposing a sentence of imprisonment is one of the objectives of punishment, disability and exclusion from the community. The United States has experienced the most use of private prisons. The reasons for the tendency to private prisons include increasing the number of prisoners, the lack of standard space, shortage of manpower, lack of financial resources, and more effective private prisons. The trend towards privatization in the United States began in Tennessee in 1980. In Iran, two cases of private prisons were executed, one was the Adel Abad Prison in Shiraz and one in Vakil Abad Prison in Mashhad, which was collected shortly after several factors. The question of research is how is the status of private prisons in Iran and the United States of America's criminal law? The present research is applied in terms of its purpose and its contents have been analyzed and compiled using library and library texts.
