Crimes and Accidents Arising from Work in Iranian and French Law

Abstract
Labor law, as one of the important legal areas, is associated with challenges in the field of crimes and accidents that require serious attention from the legislator and the responsible authorities. There are weaknesses in the labor and criminal law system, including insufficient attention to safety issues, protective techniques, and occupational health. These factors can lead to an increase in accidents in workplaces. Therefore, it is essential that legislators and relevant authorities identify and correct these weaknesses in order to prevent such problems from occurring in the future. French laws in this field, inspired by the principles of human rights and social justice, have tried to create a balance between the interests of employers and workers and prevent the occurrence of crimes and accidents at work through supervisory and preventive mechanisms. Therefore, the purpose of this research is to conduct a comparative study of crimes and accidents at work in Iranian and French law. In this regard, the objectives of this research are to eliminate the shortcomings of the crimes contained in the labor law by the institutions related to legislation and governments based on domestic laws and to increase the awareness of workers and employers about their rights and entitlements in the courts. The findings confirm that in the Iranian legal system, the labor law follows unilateral protection policies in which workers are placed in a weaker position than employers. Although this law intends to protect workers, it faces challenges in practice. Therefore, it is necessary for the legislator to implement more protective measures to guarantee the rights of workers in preventing these crimes and incidents.
