Legal and Administrative Effects of Acquisition on the Registered Status of Real Estate in the Iranian Legal System

Abstract
Property acquisition in the Iranian legal system, regardless of its origin, leaves behind numerous legal and administrative effects, the most important of which is manifested in the property registration status. Property registration in Iran has two stages: registering the property in the real estate office and issuing a title deed, and any change in ownership requires specific registration procedures that are subject to the mandatory rules of the Law on Registration of Documents and Real Estate. The purpose of the present study is to examine and analyze the effects of acquisition on the property registration status and to explain the interaction between the substantive rules of civil law and the formal procedures of property registration. The main question is what effects does acquisition have on the property registration status and how are the administrative procedures for registering these works regulated in the Iranian legal system? Also, what are the gaps and challenges in this process? The research was conducted using a descriptive-analytical method and using library resources, registration laws and regulations, and unanimous opinions. The findings of the study show that although the legislator has foreseen specific procedures for registering property transfers, there are gaps such as the lack of effective obligation to officially register transactions, ambiguity in the registered status of properties resulting from forced acquisition, conflict between notaries and registration offices in determining ownership, and the multiplicity of decision-making authorities in the process of establishing ownership. These challenges lead to numerous lawsuits and reduce the validity of official documents. As a result, amending registration laws with the aim of making official registration of all property transactions mandatory, creating an integrated property database, and clarifying registration processes is necessary to ensure the legal security of owners and reduce property claims.
