Children born from illegitimate relationships in Iran are born as a result of adultery and according to the laws, these children are attached to the adulterer and the adulteress, and the rights and duties that the law and custom provide for legitimate children are also applicable to illegitimate children. The issue discussed in this research is the gross difference between legitimate and illegitimate children in terms of their identity documents, which will be visible and tangible if the adulterer, or in other words, the father of the child, does not obtain an identity card. In this article, the issuance of identity documents for illegitimate children has been comparatively examined in custom, law, and international documents, and appropriate and efficient legal solutions have been proposed to reduce this difference between children and, consequently, humans. حق داشتن اسناد هویتی به عنوان یکی از حقوق اولیه اشخاص از بدو تولد ایجاد می گردد و نمی توان وجود آن را به مشروع یا نامشروع بودن رابطه پدر و مادر وی مربوط دانست. اطفال متولد شده از روابط نامشروع در ایران در اثر عمل زنا به وجود می آیند و مطابق قوانین، این اطفال ملحق به زانی و زانیه هستند و حقوق و تکالیفی که قانون و عرف برای کودکان مشروع در نظر دارد برای کودکان نامشروع نیز جاری است. موضوعی که مورد بحث این پژوهش می باشد، تفاوت فاحش میان کودکان مشروع و نامشروع ازحیث اسناد هویتی آن ها است که اگر زانی یا به عبارتی پدر طفل اقدام به اخذ شناسنامه ننماید این تفاوت مشهود و ملموس خواهد شد. در این پژوهش صدور اسناد هویتی اطفال نامشروع با توجه به عرف، قانون و همچنین اسناد بین المللی مورد بررسی تطبیقی قرار گرفته است و راهکارهای حقوقی مناسب و کارآمد برای کاهش این تفاوت میان کودکان و به تبع آن انسان ها پیشنهاد شده است. https://www.pzhfars.ir/article_223740_bd14427208120b6518bd5f57e2f78ecb.pdf
