What is more, the right to the environment is accepted as one of the concepts of the third generation of human rights in the international arena. Therefore, the implementation of this right is subject to its recognition and evaluation. The question is how the tools of criminal law as a guarantee of law enforcement in the field of environment can support this pillar of human rights? In other words, is a criminal enforcement guarantee sufficient to protect this right? This article tries to achieve new approaches in this field by descriptive-analytical method and by using library resources in the domestic and international field with the aim of explaining the criminal tools in support of this right while guaranteeing criminal performance and the existing challenges. At this stage, the hypothesis of the question is that the protection of the right to the environment in the domestic and international arenas, in addition to the protection of deterrent laws, requires the promotion of cultural foundations and the growth of economic and even political affairs of societies that have not been seen before. امروزه حق بر محیط‌زیست از نوع حقوق بشر است که در حوزه حقوق ‌داخلی و بین‌الملل از موضوعات بسیار مهم قلمداد می‌گردد. چه این که حق بر محیط‌زیست به عنوان یکی از مفاهیم نسل سوم حقوق‌بشر در عرصه بین‌الملل پذیرفته شده ‌است. بنابراین اجرای این حق منوط به بازشناسی و ارزیابی آن می‌باشد. مسئله این ‌است که ابزارهای حقوق‌کیفری به عنوان ضمانت اجرای قانونی در حوزه محیط‌زیست چگونه می‌تواند از این رکن حقوق‌ بشری حمایت نماید؟ به تعبیر دیگر آیا ضمانت اجرای کیفری برای حمایت از این حق کافی است؟ این مقاله تلاش می‌کند تا با روش توصیفی - تحلیلی و با استفاده از منابع کتابخانه‌ای در حوزه داخلی و بین‌الملل با هدف تبیین ابزارهای کیفری در راستای حمایت از این حق، ضمن پرداختن به ضمانت اجراهای کیفری و چالش‌های موجود به رهیافت‌های نوین در این حوزه دست یابد. در این مرحله فرضیه سوال مطرح شده این‌ است که حمایت از حق بر محیط‌زیست در عرصه داخلی و بین‌المللی علاوه بر حمایت‌های قوانین بازدارنده، نیازمند ارتقاء مبانی فرهنگی و رشد امور اقتصادی و حتی سیاسی جوامع است که در حال حاضر دیده نشده‌ است. https://www.pzhfars.ir/article_142460_70552539139fe8971ecc13b89eca2b8e.pdf
