Among these, the works of Saadi Shirazi, a writer and thinker of the seventh century AH, have several propositions close to the teachings of modern public law that have been less studied and explained. The present study uses a library method to collect data and a descriptive and analytical method to formulate the discussion. As a result, Saadi Shirazi has striking similarities with the teachings of modern public law on the popular roots of government as the basis of its legitimacy and condition for its survival, and the need to respect the rights of the people as the functional norm of government and its emphasis on rationalism and meritocracy. In some anecdotes, he has even conceptualized modern norms such as freedom of criticism, the principle of legitimated expectations, and the principle of proportionality. علیرغم این که آموزه‌های حقوق عمومی به عنوان هنجارهای حاکم بر ساختار و رفتار قدرت سیاسی، ریشه در جغرافیای فکریِ غرب و تاریخ قرون جدید دارد، می‌توان رگه‌هائی از اندیشه‌های دولت‌پژوهانه را در آراء اندیشمندان قرون گذشته شرق و به‌ویژه حوزه تمدنی ایران ردیابی کرد. از این میان، آثار سعدی شیرازی ادیب و اندیشمند قرن هفتم هجری، گزاره‌های متعددی قریب به آموزه‌های حقوق عمومی مدرن دارد که کمتر مورد مطالعه و تبیین قرار گرفته‌اند. پژوهش حاضر با استفاده از روش کتابخانه‌ای به جمع‌آوری داده ‎ها و با روش توصیفی و تحلیلی به تدوین بحث پرداخته است. حاصل این که، سعدی شیرازی در باور به ریشه مردمی حکومت به عنوان مبنای مشروعیت و شرط بقاء آن، لزوم رعایت حقوق مردم به عنوان هنجار عملکردی حکومت، تأکید بر خِرَدگرائی و شایسته‌گزینی، قرابت‌های شگفت‌آوری با آموزه‌های حقوق عمومی مدرن دارد و حتی در بعضی حکایت‌ها، هنجارهای مدرنی چون آزادی نقد، اصل رعایت انتظارات موجه و اصل تناسب را مفهوم‌پردازی کرده است. https://www.pzhfars.ir/article_142459_e8886937fd7a2a06cf4f936254b430b0.pdf
