With the intervention of the Security Council and a few peace-loving states, conflict escalation and the massacre of civilians, the question has arisen of whether the International Criminal Court (ICC/the Court) is able and qualified to play a role to curb the conflict? The feasibility study on the role of ICC is the subject and also the main question of this article. The purpose of feasibility study is the role playing of ICC in the Yemen conflict and to analyze the types of jurisdictions of the Court to investigate the crimes alleged by the international organizations. This manuscript has tried to answer the mentioned question through assessing the alleged violations of Statute and checking the types of jurisdictions and also the elements of crimes according to the Statute of the Court. The pursued hypothesis is that ICC does not have jurisdiction unless the Security Council refers a case to it. The passage of the article demonstrates that if any case is referred to the Court, the probability of fulfillment of the elements of the crimes mentioned under Article 5 of the Statute, namely the mens rea and actus reus, against the coalition is loose. Although the reports of some international organizations suggest the commitment of international crimes in this conflict, states have no tendency to impose universal jurisdiction to proceed with the accusations. Eventually the conclusion is that the role playing of this institution in the Yemen conflict is difficult or even impossible. The impossibility for the Court to play a role in this conflict is mainly due to the lack of ratification of the Rome Statute by the states involved in the Yemen conflict.}, keywords = {Keywords: International Criminal Court,Yemen,Security Council,International Crime,Jurisdiction}, title_fa = {مخاصمه یمن؛ امکان‌سنجی نقش‌آفرینی دیوان کیفری بین المللی}, abstract_fa = {چکیده مخاصمه یمن موجب نقض اصل عدم توسل به زور در حقوق بین‌الملل شده است. با مداخله شورای امنیت و برخی دولت‌های صلح دوست، گسترش درگیری‌ها و قتل غیرنظامیان، این پرسش مطرح شده است که آیا دیوان کیفری بین‌المللی توان و صلاحیت نقش‌آفرینی برای پایان دادن به مخاصمه را دارا می‌باشد؟ امکان‌سنجی نقش‌آفرینی دیوان موضوع و پرسش اصلی این مقاله می‌باشد. منظور از امکان‌سنجی نقش‌آفرینی دیوان، همان تجزیه و تحلیل اقسام صلاحیت‌های این نهاد برای رسیدگی به جنایات مورد ادعای سازمان‌های بین‌المللی می‌باشد. این نوشته با بررسی انواع صلاحیت‌ها و نیز عناصر جرم مطابق با اساسنامه دیوان، سعی داشته با تشخیص موارد ادعا شده نقض اساسنامه، به سوال پیش گفته پاسخ دهد. فرضیه مورد تعقیب این است که دیوان صلاحیت ندارد، مگر آن که شورای امنیت پرونده را به دیوان ارجاع دهد. سیر مقاله نشان می دهد که در صورت ارجاع پرونده به دیوان به احتمال زیاد احراز تحقق عناصر جرم، یعنی عنصر روانی و عنصر مادی جرایم مذکور در ماده (5) اساسنامه، علیه نیروهای ائتلاف منتفی می‌باشد. هر چند گزارشات برخی سازمان‌های بین‌المللی به ارتکاب جنایات بین‌المللی در این مخاصمه اشاره دارد، اما دولت ها نیز تمایلی به اعمال صلاحیت جهانی نسبت به دادرسی اتهامات ندارند. در نهایت این نتیجه حاصل شده که نقش‌آفرینی این سازمان در مخاصمه یمن امری دشوار، بلکه احتمالاً منتفی خواهد بود. عدم امکان نقش‌آفرینی دیوان در این مخاصمه عمدتاً معلول عدم تصویب اساسنامه رم توسط دولت‌های مداخله کننده در مخاصمه یمن می‌باشد.}, keywords_fa = {واژگان کلیدی: دیوان کیفری بین‌المللی,یمن,شورای امنیت,جنایت بین المللی,صلاحیت}, url = {https://www.pzhfars.ir/article_106465.html}, eprint = {https://www.pzhfars.ir/article_106465_e8e5e23a42f4a4aae1aa61c4c2b4cc0c.pdf} }
