امکان‌سنجی تحقق ایده جرم انگاری (جرم مسئولیت مدنی مدیران) از تئوری تا عمل بر اساس رویکردهای مدل مسئولیت کیفری قانون اقدام راهبردی لغو تحریم ها

چکیده

بدون تردید امروزه یک سری از مشکلاتی که در جامعه شاهد آن می‌باشیم و گریبان مردم گرفته است به چند عامل بستگی دارد که عامل سوءمدیریت می‌تواند نقش بسیار کلیدی و راهبردی در به وجود آمدن وضع موجود داشته باشد. مدیرانی که بدون داشتن تخصص و برنامه‌ریزی‌های لازم مناصب مختلف حساس را در دست می‌گیرند که گهگاه تصمیماتی می‌گیرند که هزینه‌ها و آثار زییان بار آن مستقیماً سال‌ها به مردم بر می‌گردد، در زندگی مردم تأثیر مستقیم دارد. با نگاهی به مدل حکومت در نظام اسلامی و حتی مدل‌های جدیدی که به توسعه برمی‌گردد همانند حکمرانی خوب، برخی از مدیریت‌های حاکم با هیچ‌یک از این ویژگی‌های مدل اسلامی و غربی خوانش ندارد. برای این که چنین افرادی بعد از دوران مسئولیت کنونی خود پاسخگوی عملکردشان در هر سطحی باشند، در این مقاله با رویکردی توصیفی-تحلیلی درصدد یافتن پاسخی مناسب برای این سؤال هستیم آیا امکان‌سنجی تحقق ایده جرم انگاری (جرم مسئولیت مدنی مدیران) پس از احراز اهمال‌کاری و تقصیرات با بهره گیری از ضمانت اجرای کیفری تعبیه شده در قانون اقدام راهبردی لغو تحریم ها وجود دارد یا خیر؟

چکیده [English]

Undoubtedly, some of the problems that we see in society today and are plaguing the people depends on several factors that mismanagement can play a very key and strategic role in creating the status quo. Managers who have no expertise and plan the necessary details are taken up by various sensitive positions, which sometimes make decisions whose costs and harmful effects go directly to the people for years, and have a direct impact on people's lives. Looking at the model of government in the Islamic system and even new models that go back to development such as good governance, some governing administrations do not read any of these features of the Islamic and Western model because such people after their current term of office to be accountable for their performance at any level, in this article, with a descriptive-analytical approach, we find the appropriate answer to the question that there is a possibility of criminalization (civil liability of the managers) after verifying negligence and fault by taking advantage of the guarantee of criminal execution embedded in the law of strategic action, is there a cancellation of sanctions or not?
