Criminal protection of mental health refers to the mentally ill who have committed a crime and their protection according to their specific situation. Accordingly, mental health should be considered as one of the pillars of criminal responsibility. Therefore, if a person does not have the necessary understanding and consciousness at the time of committing a crime, it is considered as insanity and he has no criminal responsibility. The present study includes two objectives, which are: applied and scientific objectives. Practical goals for judicial authorities, psychologists and psychiatrists, and scientific goals such as elaborating on the concept of mental disorders and its types. The article is a descriptive-analytical method in which different texts will be analyzed and finally concluded. Attempts have also been made to use jurisprudential sources, psychology, criminal law and relevant laws to provide an appropriate answer to the main question (what is the criminal protection of mental health?) In the legal structure. Consequently, in order to achieve the desired solution, one must understand the mental disorder and its causes and symptoms; Mental disorders cover a wide range and the extent depends on the opinion of experts and forensic medicine; The legislator has also referred to this issue in order to protect this special group in articles of the Islamic Penal Code approved in 2003.
