Evaluating the costs of crime in order to reduce the effects of punishments is one of the most important components of criminal justice, which has a long history in the judicial and legislative system of Shiite jurisprudence and criminal law. Findings of criminology and criminal policy indicate that the governing systems in countries are not willing to analyze and explain this dimension of criminal law; while the cost-benefit index is a suitable tool for evaluating the results of policies and legislative strategies. A tool that assists the legislature in assessing the costs and benefits of various criminal policies against crime and delinquency, which promotes the level of well-being and security of social welfare for all segments of society. Therefore, the ruling system can achieve optimal resource allocation, where it faces a shortage of resources. Also, the application of criminal reactions commensurate with criminal behavior has been raised as one of the high goals of economic policies in criminal law and Shiite jurisprudence, and in this regard, they explain the economic perspective of punishment. In this article, with a descriptive-analytical method and with a practical approach, we will analyze the approach of criminal law and Shiite jurisprudence regarding the evaluation of the cost of the criminal phenomenon.
