In order to receive amounts as income in this way, and for this reason, laws and regulations have been developed in the field of court costs in the judiciary. In view of the above, the determination of court costs is subject to the terms and conditions that the legislator determines according to different cases. The Code of Civil Procedure does not provide a specific definition in the discussion of court costs and only in Article 502 it is sufficient to determine its cases. Because litigation is an inalienable right of every person and it is not possible to prevent people from going to court by incurring huge costs and increasing it annually. Or postponed litigation and the administration of justice and made it subject to the payment of court fees, which is an example of the prohibition of going to the courts to which people have the unconditional right to go. Under French law, the country's civil procedure provides for the conviction of the convicted person for the costs of the proceedings. The French Supreme Court has ruled that the division of costs between the parties is within the discretion of the trial judges. Thus, in the Iranian legal system, it is necessary for the judge to be able to pay attention to the economic situation of the parties and the demands of the lawsuit. Also in France, in order to help people who do not have financial resources, an institution called the Legal Aid Institution has been established, which requires steps to receive this assistance, such as a life sentence, and if proven, the beneficiary will pay the fees of legal assistants and Other ancillary costs are exempt.}, keywords = {Cost of Litigation,Convict,usury,Government,victim}, title_fa = {جایگاه هزینه دادرسی از منظر فقه امامیه، حقوق ایران و فرانسه}, abstract_fa = {هزینه‌های دادرسی را می‌توان از جمله مهم ترین بخش‌های تشکیل دهنده دادرسی دانست که به عنوان یک اصل در حقوق کشور ما پذیرفته شده است و طرح دنبال کردن دعوا در هر مرحله‌ای از مراحل دادرسی منوط به پرداخت هزینه دادرسی می‌باشد که اصولاً دولت‌ها به کمک دستگاه تقنینی تلاش می‌نمایند تا از این طریق مبالغی را به عنوان درآمد دریافت نمایند و بدین جهت قوانین و مقرراتی در زمینه هزینه‌های دادرسی در دادگستری تدوین یافته است. با توجه به موارد فوق تعیین هزینه‌های دادرسی تابع شرایط و مقرراتی است که قانونگذار با توجه به موارد مختلف آن را تعیین می‌نماید. قانون آئین دادرسی مدنی در بحث هزینه‌های دادرسی تعریف به خصوصی انجام نداده و تنها در ماده 502  به تعیین موارد آن اکتفا نموده است. از آن جا که دادخواهی حق مسلم هر فرد است و نمی‌توان با اخذ هزینه‌های هنگفت و افزایش سالانه آن، مردم را از رفتن به محاکم منع نمود یا دادخواهی و اجرای عدالت را موکول و منوط به پرداخت هزینه های دادرسی نمود که خود نمونه ای از ممانعت مراجعه به دادگاه هایی است که مردم بدون قید و شرط حق مراجعه به آن را دارند. در حقوق فرانسه، آئین دادرسی مدنی این کشور محکومیت محکوم‌علیه به هزینه‌های دادرسی را مدنظر قرار داده است. دیوان عالی کشور فرانسه تقسیم هزینه‌ها میان طرفین را از اختیارات تشخیص قضات رسیدگی ماهوی دانسته است. بدین ترتیب لازم است در نظام حقوقی ایران نیز قاضی بتواند به موقعیت اقتصادی طرفین و خواسته دعوا توجه کند. همچنین در فرانسه به منظور کمک به افرادی که بضاعت مالی ندارند، نهادی به نام نهاد کمک حقوقی تأسیس شده که جهت دریافت این کمک همانند حکم اعسار نیازمند مراحلی است و در صورت اثبات، فرد بهره‌مند از این کمک از پرداخت هزینه و حق‌الزحمه دستیاران قضایی و سایر هزینه‌های جانبی معاف می‌گردد.}, keywords_fa = {هزینه دادرسی,محکوم‌علیه,اعسار,دولت,بزه‌دیده}, url = {https://www.pzhfars.ir/article_149753.html}, eprint = {https://www.pzhfars.ir/article_149753_6ab3ef5851e1f921d1564ddd4656baee.pdf} }
